Case & Cocoa — Terms of Service

These Terms of Service ("Terms") govern your use of the Case & Cocoa mobile application ("App"), developed and operated by Blackhole Software, LLC doing business as CrashBytes ("we", "our", or "us"). By downloading, installing, or using the App, you agree to these Terms.

1. The Service

Case & Cocoa is a daily cozy mystery puzzle app. Each day a new mystery case is made available inside the App. You investigate clues, submit a deduction, and your solved cases are recorded in an illustrated journal on your device. The App includes an optional companion that can be decorated, a streak tracker, a friend-compare feature, and a lock-screen widget.

Case & Cocoa is intended for personal, non-commercial use and is rated 12+ on the App Store.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you confirm that you meet this age requirement. The App is not directed at children under 13 and does not offer a family plan or a dedicated children's mode at this time.

3. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, disassemble, or derive the source code of the App
• Circumvent or tamper with our streak system, entitlement validation, or rate limits
• Use automated systems, bots, or scripts to interact with the App or our servers
• Abuse the friend invite system to harass, spam, or deceive other users
• Redistribute, sublicense, or resell access to the App or its content
• Interfere with the App's functionality, servers, or network infrastructure

4. Subscriptions and In-App Purchases

Case & Cocoa offers the following in-app purchases, referred to together as Cozy Pass:

• Cozy Pass Monthly — $4.99 USD, auto-renewing monthly subscription.
• Cozy Pass Yearly — $29.99 USD, auto-renewing annual subscription with a 14-day free trial on first purchase. Payment is charged at the end of the free trial unless cancelled at least 24 hours before the trial ends.
• Cozy Pass Forever — $59.99 USD, a one-time non-consumable purchase that provides lifetime access to Cozy Pass features.
• Cosmetic bundles — one-time non-consumable purchases ($1.99–$4.99) unlocking decorative outfits and room items for your companion.

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends. Payment is charged to your Apple ID account at confirmation of purchase and at each renewal. You can manage subscriptions, turn off auto-renewal, or request a refund at any time by going to your Apple ID account settings on the App Store after purchase.

All payments are processed by Apple through the App Store. We do not collect or store any payment information. Refunds are handled by Apple in accordance with their refund policy. Prices shown are in U.S. Dollars; prices in other currencies are converted by Apple at the time of purchase.

5. Content License

We don't take your content. Journal notes you write in the App remain yours. We do not claim any ownership, license, or right to use your personal notes, and we never transmit them off your device (except, at your option, to your own private iCloud container).

The App's case text, illustrations, companion art, and UI are the intellectual property of Blackhole Software, LLC and are protected by copyright. You may not reproduce, distribute, modify, or create derivative works of the App's content without our prior written permission.

6. Friend Invites and Community Conduct

The friend-invite feature exists to let you connect with people you already know. You are responsible for the invite links you generate and share. We reserve the right to remove accounts that abuse the invite or nudge system. There is no open chat, direct messaging, or user-generated text in the App; only pre-defined emoji reactions and nudges.

7. Account Deletion

You can delete your account at any time from Settings > Delete Account. Deletion removes your data from our servers, purges your iCloud CloudKit zone (if enabled), and wipes the App's local storage on your device. This action is permanent and cannot be undone.

8. Third-Party Services

The App uses Apple StoreKit (for purchases), Apple Sign in with Apple (for authentication), Apple CloudKit (for optional iCloud sync), Google Firebase Analytics and Crashlytics (for aggregate usage and crash reporting), and Cloudflare (for daily case delivery and the friend system). Your use of these services is also subject to their respective terms. We are not responsible for the practices or availability of third-party services.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand what information we collect and how we use it.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT DAILY CASES WILL BE AVAILABLE ON ANY GIVEN DAY.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BLACKHOLE SOFTWARE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PROGRESS, LOSS OF STREAK, LOSS OF DATA, OR BUSINESS INTERRUPTION.

12. Indemnification

You agree to indemnify and hold harmless Blackhole Software, LLC from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be announced in-app and the "Last updated" date at the top of this page will be revised. Your continued use of the App after a change constitutes acceptance of the modified Terms.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason including violation of these Terms. Paid subscription fees are non-refundable except as required by Apple's refund policy.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to conflict of law principles. Any dispute arising from or related to these Terms shall be resolved in the state or federal courts located in Ohio.
